Refund and Returns Policy

1. Introduction

This Returns & Refunds Policy explains the conditions under which customers may return products purchased from Titan International and request refunds.

This policy operates in conjunction with applicable Maltese and European Union consumer protection legislation.

Nothing contained in this policy limits any statutory rights available to consumers.

2. Right to Cancel Online Orders

Customers purchasing products through the Titan International website may be entitled, subject to Section 5, to cancel their purchase within fourteen (14) days from the date of delivery in accordance with applicable distance selling regulations.

To exercise this right, customers must notify Titan International in writing before the expiry of the cancellation period.

3. Return Conditions

To qualify for a return, products should:

  • Be unused;
  • Be in their original condition;
  • Include original packaging where reasonably possible;
  • Include all accessories, manuals and documentation supplied with the product.

Customers are responsible for taking reasonable care of the goods until they are returned.

4. Return Procedure

Customers wishing to return products should contact Titan International before returning any goods.

Customers may be asked to provide:

  • Order number;
  • Invoice number;
  • Product details;
  • Reason for return;
  • Photographs where appropriate.

Titan International may provide return instructions depending on the product involved.

5. Non-Returnable Products

The following products may not be eligible for return except where defective or required by law:

  • Special-order products;
  • Products sourced specifically for a customer;
  • Custom-made products;
  • Installed products;
  • Products altered after delivery;
  • Products damaged by misuse;
  • Products not returned in a reasonable condition.

6. Faulty or Damaged Products

Customers should inspect products upon delivery.

If a product is:

  • Damaged in transit;
  • Incorrectly supplied; or
  • Defective,

customers should notify Titan International as soon as reasonably possible.

Titan International may request photographs, videos or additional information to assist with the claim.

7. Remedies for Faulty Products

Where a claim is accepted, Titan International may, at its discretion and in accordance with applicable law:

  • Repair the product;
  • Replace the product;
  • Supply replacement components;
  • Arrange collection of the goods;
  • Provide a refund.

8. Refund Processing

Approved refunds will normally be processed using the original payment method.

Refund processing times may vary depending on:

  • Banks;
  • Payment providers; and
  • Financial institutions.

Titan International shall not be responsible for delays caused by third-party payment providers.

9. Return Costs

Customers are generally responsible for return shipping costs unless:

  • The product is faulty;
  • The wrong product was supplied;
  • Return costs are otherwise required by law.

Where Titan International agrees to arrange collection, additional instructions will be provided.

10. Installed Products

Products that have been installed may not be eligible for return unless:

  • The product is defective;
  • The installation was carried out by Titan International and a fault is confirmed; or
  • Consumer protection legislation requires otherwise.

11. Marine Products

Marine air conditioning products may require inspection before any warranty or return claim can be assessed.

Returns may be refused where defects are caused by:

  • Incorrect installation;
  • Corrosion;
  • Water ingress;
  • Improper electrical supply;
  • Unauthorised modifications.

12. Refused Returns

Titan International reserves the right to refuse returns where:

  • Products have been used;
  • Products have been damaged after delivery;
  • Products are incomplete;
  • Products are returned outside applicable legal time limits.

Where a return is refused, products may be returned to the customer at the customer’s expense.

13. Limitation of Liability

Titan International shall not be liable for:

  • Loss of income;
  • Loss of business;
  • Consequential losses;
  • Indirect damages arising from returned or defective products.
